This Privacy Policy explains how Sway9 ("Sway9", "we", "us", or "our") collects, uses, shares, and protects personal information when you visit or use sway9.com and the Sway9 creator-campaign management platform (together, the "Services"). Sway9 is a product operated by Core Habits, and references to "we" in this Policy refer to that operator acting through the Sway9 service. By using the Services, you agree to the practices described in this Policy; if you do not agree with them, please do not use the Services, and if anything here is unclear you can always write to us at the address in Section 12 before deciding.
1. Information we collect
Information you provide to us
- Account information. When you create an account, we collect your name, email address, and profile details. If you sign in with Google, we receive the name, email address, and profile picture associated with your Google account. We never receive your Google password.
- Workspace content. Information you enter while using the platform, such as campaign details, creator contact information you manage, social media handles, post links, and performance notes.
- Communications. Messages you send us, including support requests, contact-form submissions, and early-access sign-ups.
- Payment information. If and when paid plans are offered, payments will be handled by third-party payment processors. We do not store full card numbers on our servers.
Information collected automatically
- Usage data — pages visited, features used, and actions taken within the Services.
- Device and log data — IP address, browser type, operating system, referring URLs, and timestamps.
- Cookies and similar technologies — see Section 5.
Publicly available social media data
The Services can display publicly available information about social media posts (such as view counts, captions, and thumbnails from TikTok or Instagram) for accounts that you or your workspace choose to track. This information is retrieved from publicly accessible pages and is processed to provide the analytics features you request.
2. How we use your information
- To provide, operate, maintain, and improve the Services;
- To create and manage your account and workspace;
- To respond to your requests and provide customer support;
- To send administrative messages, such as changes to our terms or policies;
- To monitor usage, prevent fraud and abuse, and keep the Services secure;
- To comply with legal obligations.
3. Legal bases for processing (EEA/UK users)
Where the EU or UK General Data Protection Regulation applies, we process personal data on these bases:
- Contract — to provide the Services you signed up for;
- Legitimate interests — to secure, analyze, and improve the Services in ways that do not override your rights;
- Consent — where required, for example for non-essential cookies or marketing emails (you may withdraw consent at any time);
- Legal obligation — where processing is required by applicable law.
4. How we share information
We do not sell your personal information. We share it only:
- With service providers that help us run the Services (such as cloud hosting and infrastructure providers, e.g. Cloudflare, and payment processors when applicable), under agreements that limit their use of your data;
- Within your workspace — content you add to a shared workspace is visible to other members of that workspace;
- For legal reasons — if required by law, legal process, or to protect the rights, safety, or property of the Services, our users, or the public;
- In a business transfer — if we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.
5. Cookies and tracking
We use cookies and similar technologies that are necessary for the Services to function (for example, keeping you signed in) and, where permitted, analytics cookies that help us understand how the Services are used. You can control cookies through your browser settings; disabling essential cookies may prevent parts of the Services from working. The Services do not currently respond to "Do Not Track" browser signals, as no consistent industry standard exists for them.
6. Data retention
We keep personal information only as long as needed for the purposes described in this Policy — generally, for as long as your account is active — unless a longer period is required by law. When information is no longer needed, we delete or anonymize it. You may request deletion of your account and associated data at any time (see Section 9).
7. Security
We use appropriate technical and organizational measures to protect personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
8. Children
The Services are not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
9. Your rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent. Residents of the EEA, UK, and Switzerland, and residents of certain US states, have these rights under their local laws. To exercise any of them, email us at contact@sway9.com. We will respond within the timeframe required by applicable law. You also have the right to lodge a complaint with your local data protection authority.
10. International transfers
We may process and store information on servers located outside your country. Where we transfer personal data internationally, we rely on appropriate safeguards such as standard contractual clauses.
11. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will notify you by posting the updated Policy on this page with a new "Last updated" date and, where appropriate, by additional notice. Your continued use of the Services after an update means you accept the revised Policy.
